Updated Government guidance on Construction UKCA

Following the DLUHC announcement that the CE mark would continue to be accepted in the GB market for construction products until end June 2025, BIAFD raised a query about the status of product on which the UK mark had been applied based on CE certification – which June 2022 guidance permitted. This was a concern for several BIAFD members.

On 23 December DLUHC responded to BIAFD, to say guidance had been updated to clarify the position. See Section 9 of the guidance (link below) which states: “In recognition that legislation has not been introduced to cover this issue, and until further notice, the Office for Product Safety and Standards (OPSS) will not take enforcement action against any economic actor solely where the UKCA mark has been used on construction products tested only by an EU recognised notified body for the purpose of CE marking where this testing was done before 31 December 2022. OPSS takes all enforcement decisions on the basis of its enforcement policy.”
